Products Liability

Dangerous and defective products can cause severe injuries and death.  Products can be defective in one of three ways:

  • Manufacturing defect: A manufacturing defect exists when a product is defective because something occurred during the manufacturing process.  With manufacturing defects, other products with the same design are not defective.  Faulty manufacturing equipment on the manufacturing line, the manufacturer’s failure to check the quality of the finished product, or the use of substandard materials can all cause a manufacturing defect.    
  • Design defect: A product that has a design defect is defective before it is manufactured because the product’s very design had a flaw.  If a product has a design defect, every item manufactured to this design will be identically defective.    
  • Defective warnings: A product is defective in its warnings if it does not come with clear and complete warnings of reasonably foreseeable hazards.  Even if an item was designed and manufactured safely, a manufacturer can be held liable for any resulting damages if the warnings and instructions are defective.
